The Commission has agreed that CCAMLR-39 will be held as a virtual meeting and will be conducted in accordance with the Commission Rules of Procedure and the ad-hoc guidelines developed for the virtual meeting. The Commission decided this through an application of Rule 7 of its Rules of Procedure (COMM CIRC 20/104; COMM CIRC 20/143). The modalities of the meeting, including the provisional agenda and schedule available on the CCAMLR website, will follow the Proposal of the Chair circulated by the CCAMLR Secretariat on 8 October 2020 following a meeting of the Heads of Delegations.

    1     Opening of meeting

    The Chair of the Commission will welcome delegates from CCAMLR Members, observers from CCAMLR Acceding States, observers from non-Contracting Parties (NCPs) and international organisations invited in accordance with the decision taken last year (CCAMLR-38, paragraphs 13.5 to 13.8) and responses received from Members in reply to COMM CIRC 20/81.

    2     Organisation of meeting
    2.1     Adoption of agenda

    The Provisional Agendas for the Thirty-ninth Meeting of the Commission, the meeting of the Standing Committee on Implementation and Compliance (SCIC) and the meeting of the Standing Committee on Administration and Finance (SCAF) were prepared and distributed in accordance with Rules 15 and 17 of the Commission’s Rules of Procedure. Following the opening of the meeting, the Commission will adopt its agenda.

    The Commission will note the ad-hoc Guidelines developed specifically for the conduct of a virtual meeting.

    3     Implementation and compliance

    The Commission will note submitted documents that have been considered by SCIC, and other documents relevant to this agenda item.

    3.1     Advice from SCIC

    The Chair of SCIC will introduce her summary of the meeting of SCIC containing advice on the implementation of compliance-related conservation measures that are not otherwise included below.

    3.2     CCAMLR Compliance Report

    The Commission will consider the advice of SCIC and adopt a CCAMLR Compliance Report.

    3.3     Illegal, unreported and unregulated (IUU) fishing in the Convention Area

    The Commission will consider the advice of SCIC and adopt NCP-IUU and CP-IUU Vessel Lists for 2020/21.

    4     Administration and Finance

    The Commission will note submitted documents that have been considered by SCAF, and other submitted documents relevant to this agenda item.

    4.1     Advice from SCAF

    The Chair of SCAF will introduce her summary of the meeting of SCAF.

    Under this agenda item, the Commission will consider all advice arising from the SCAF report that is not elsewhere addressed in this Commission agenda. This will include, inter alia:

    • Staffing matters including changes to the CCAMLR Job Classification Scheme as recommended in the Report of the Executive Secretary
    • Recommendations in respect of the activity of the General Capacity Building Fund and the General Science Capacity Fund.
    4.2     Review of the 2020 budget, 2021 budget and forecast budget for 2022

    The Chair of SCAF will report on the status of the 2020 budget and introduce the forecast budget for 2021 as advised by SCAF.

    The Commission will consider advice from SCIC and the Scientific Committee in respect of the 2021 budget and forecast budget for 2022.

    The Commission will adopt a budget for 2021 and note a forecast budget for 2022.

    5     Management of marine resources
    5.1     Advice from the Scientific Committee

    The Chair of the Scientific Committee will introduce the report of the 39th Meeting of the Scientific Committee.

    The Commission will consider all advice arising from the Scientific Committee that is not elsewhere addressed in this Commission agenda.

    The focus for Commission consideration under all other item 5 agenda items will be related to revision of current conservation measures (please see additional annotation under item 6 below).

    5.2     Notifications
    5.2.1     Notifications for exploratory and krill fisheries

    The Commission will consider the advice of SCIC and the Scientific Committee in respect of notifications for fishing in exploratory and krill fisheries the 2020/21 fishing season.

    5.2.2     Research fishing notifications under CM 24-01, paragraph 3

    The Commission will not consider new proposals for research fishing under CM 24-01, paragraph 3.

    The Commission will remove expired research proposals from CM 24-05 for the 2020/21 fishing season.

    5.3     Harvested species
    5.3.1     Krill resources

    The Commission will consider the advice of the Scientific Committee on the extension, for the 2020/21 fishing season, of the following conservation measure which will lapse in 2020:

    The Commission will consider the advice of the Scientific Committee on the extension, for the 2020/21 fishing season, of the following conservation measures which will lapse in 2020:

    The Commission will consider advice from the Scientific Committee on other conservation measures that will not lapse, including:

    5.4     Non-target species
    5.4.1     Fish and invertebrates

    The Commission will consider the advice of the Scientific Committee on the extension, for the 2020/21 fishing season, of the following conservation measures which will lapse in 2020:

    5.4.2     Seabirds and marine mammals

    The Commission will consider any advice on the impact of fisheries on seabirds and marine mammals which relates to current conservation measures, including any proposal to extend CM 25-03, footnote 2, to the 2020/21 fishing season.

    5.4.3     Bottom fishing and vulnerable marine ecosystems

    The Commission will consider any advice on vulnerable marine ecosystems (VMEs) which relates to current conservation measures.

    6     Conservation measures
    6.1     Review of existing measures

    The Commission will consider the advice of SCIC, SCAF and the Scientific Committee in respect of existing conservation measures and shall adopt a Schedule of Conservation Measures in Force for 2020/21.

    Because of the virtual nature of the meeting for CCAMLR-39, the Commission will focus its attention on those conservation measures that lapse or will need to be modified in 2020. These are the Conservation Measures listed under items 6.3 and 6.4 above. The advice from SCIC and the Scientific Committee will inform the Commission on whether the conservation measures that will lapse in 2020 can be extended to apply to the 2020/21 fishing season, subject to an adjustment of applicable dates and, in respect of exploratory fisheries, modification of the list of applicable Members in line with the notifications for the 2020/21 fishing season.

    The Commission will also consider advice raised on any other Conservation Measure.

    6.2     Impacts of COVID-19 on the 2020/21 fishing season

    The Commission will consider the impact of the COVID-19 pandemic on the implementation of conservation measures in the 2020/21 season.

    7     Administrative matters
    7.1     Election of officers

    Under Rule 8 the Commission will elect a Chair for a two-year term starting from the end of the 2020 Commission meeting.

    The Commission, taking into account the advice of SCIC or SCAF will either make appointments to the following positions or will agree to extend the appointment terms of the current office holders for one more year:

    • the Chair of SCAF for the meetings in 2021 and 2022
    • the Vice-Chair of SCAF for the meetings in 2021 and 2022
    • the Chair of SCIC for the meetings in 2021 and 2022
    • the Vice-Chair of SCIC for the meetings in 2021 and 2022.
    7.2     Appointment of the Executive Secretary

    The Executive Secretary’s first four-year term will conclude in April 2022. He is eligible for reappointment. The Commission will consider this reappointment, or the process to support selection of a new Executive Secretary, as necessary.

    7.3     Invitation of observers

    The Commission will decide on the Acceding States, NCPs and international organisations that will be invited to CCAMLR-40.

    7.4     Next meeting

    The Commission will confirm that, as decided at CCAMLR-38, the dates of CCAMLR-40 will be 18 to 29 October 2021.

    8     Other business
    8.1     Implementation of Objectives of the Convention

    No working papers have been submitted for this agenda item.

    In 1996, the Commission agreed that reflection on the objectives of the Convention is an important requisite of each annual meeting. In 2019 the Commission agreed that that this should take place early in the meeting. Given the limited time available for this item at the CCAMLR-39 virtual meeting, the Commission will hold over discussions of the Regulatory Framework (CCAMLR-38 paragraph 5.34) and the 2nd Performance Review to CCAMLR-40 which are normally considered under this agenda item. 

    8.2     Spatial management
    8.2.1     General issues related to spatial management

    The Commission will consider general spatial management issues, including the establishment of newly exposed marine areas following ice-shelf retreat or collapse as Special Areas for Scientific Study (CM 24-04) and any advice of the Scientific Committee.

    8.2.2     Review of existing marine protected areas (MPAs)

    The Commission will review the implementation of existing marine protected areas (MPAs) and any advice of the Scientific Committee.

    8.2.3     Review of proposals for new MPAs

    The Commission will review proposals for new MPAs.

    8.3     Impacts of climate change on the conservation of Antarctic marine living resources

    No working papers have been submitted for this agenda item.

    The Commission will consider the impacts of climate change on the conservation of Antarctic marine living resources and any advice of the Scientific Committee.

    8.4     Cooperation with the Antarctic Treaty System and international organisations

    The Commission will note Observer reports submitted as background papers.

    8.4.1     Cooperation with the Antarctic Treaty System

    ATCM XLIII was postponed.

    8.4.2     Cooperation with international organisations
    8.4.2.1     Reports of observers from international organisations

    The following international organisations have been invited to attend CCAMLR-39 as observers: ACAP, CCSBT, CEP, CITES, COMNAP, FAO, IATTC, ICCAT, IOC, INTERPOL, IUCN, IWC, South East Asia RPOA-IUU, SCAR, SCOR, SEAFO, SIOFA, SOOS, SPRFMO, UNEP and WCPFC. The following non-governmental organisations have also been invited to attend CCAMLR-39: ARK, ASOC, COLTO, IAATO and Oceanites Inc.

    Observer reports from some of these organisations will be available as background papers.

    8.4.2.2     Reports from CCAMLR representatives at meetings of international organisations in the previous intersessional period and nominations of representatives to forthcoming meetings of relevant international organisations

    Reports from CCAMLR representatives at the 2020 meetings of various international organisations (CCAMLR-38, Table 1) will be available as background papers.

    The Chair will invite nominations for CCAMLR Observers to forthcoming meetings of international organisations.

    8.5     Other items
    9     Report of the 39th Meeting of the Commission

    The report of the 39th Meeting will be considered and adopted.
